Due diligence should match the property

There is no single search that proves every Nigerian property transaction is safe. The appropriate enquiries depend on the state, the type of title, the ownership history, the seller, the physical location, and the buyer's intended use.

A review may involve land-registry searches, survey verification, planning or acquisition checks, probate or family-authority documents, corporate records, and enquiries about possession. The findings need to be read together. A registry result does not cure a boundary problem, and physical occupation does not by itself establish transferable title.

Control payment and completion risk

Transaction documents should connect payment milestones to the evidence and documents the buyer expects to receive. They should also address representations about ownership, vacant possession where relevant, existing tenants or encumbrances, default, and the steps required before completion.

Where a transaction cannot close immediately, the parties may need carefully defined conditions rather than an informal promise that documents will be supplied later. We help clients identify which safeguards are proportionate to the risk and bargaining position.

Plan beyond the signature

After the parties sign and complete, further steps may be required for stamping, consent, registration, or updating relevant records. The documents retained at completion can determine whether those later processes are straightforward.

We explain the expected post-completion path and help the client keep the executed instruments, receipts, approvals, and supporting evidence needed to protect the acquired interest.
